Terms of Service

Agreement

These Terms of Service govern your access to and use of FitAdEngine, a FitMacro product available at fitadengine.com and related FitMacro-operated domains. By creating an account, connecting a third-party platform, or using FitAdEngine, you agree to these Terms. If you do not agree, do not use the service.

Use of the Service

FitAdEngine helps teams create, manage, review, publish, and analyze app marketing creative. Features may include campaign briefs, AI-generated hooks and concepts, uploaded media libraries, image and video rendering, app growth analytics, daily image workflows, trend scouting, social account connections, publishing records, and performance reporting.

You are responsible for your account, your workspace users, your campaign content, your connected accounts, and your compliance with applicable laws, advertising rules, intellectual property rules, privacy obligations, and third-party platform policies.

Connected Platforms

If you connect TikTok, Meta, YouTube, Apple App Store Connect, Stripe, or another third-party platform, you authorize FitAdEngine to use that connection to provide the features you request. This may include storing tokens, retrieving account metadata, importing analytics, preparing content, recording publishing status, or initiating publishing actions you request.

Your use of connected platforms remains subject to their own terms, developer policies, community guidelines, advertising rules, API limits, and review processes. You are responsible for ensuring you have the authority to connect each account and use any data, media, or content imported from those platforms.

User Content

You retain ownership of campaign briefs, media, creative assets, and other content you upload or create in FitAdEngine. You grant FitAdEngine the rights needed to host, process, transform, generate from, render, display, store, transmit, and otherwise use that content for the purpose of operating, securing, and improving the service.

You represent that you have all rights, permissions, consents, and licenses needed for the content you upload, connect, generate, approve, publish, or instruct FitAdEngine to process.

Acceptable Use

You may not use FitAdEngine to violate laws, infringe intellectual property rights, upload malicious code, abuse connected platform APIs, interfere with the service, misrepresent your identity, scrape or exfiltrate data, bypass rate limits, reverse engineer the service, or generate or publish content that you do not have the right to use.

You may not use FitAdEngine to create, upload, or publish content that is unlawful, deceptive, discriminatory, harassing, sexually exploitative, hateful, violent, malware-related, privacy-invasive, or otherwise prohibited by applicable platform policies.

AI-Generated Output

FitAdEngine may use AI providers to generate copy, concepts, images, video-related assets, or recommendations. You are responsible for reviewing outputs before use, including for accuracy, rights clearance, factual claims, regulated-product claims, advertising compliance, and platform policy compliance.

AI-generated output may be inaccurate, incomplete, similar to other content, or unsuitable for a particular campaign. FitAdEngine does not guarantee that generated output will be approved by TikTok, Meta, YouTube, Apple, Google, app stores, ad networks, or any other platform.

Publishing and Review

FitAdEngine may help prepare, queue, record, or publish content to connected platforms. You are responsible for final review and approval of all content before it is published or used in an advertisement. We may remove or disable content, connections, or accounts that we believe violate these Terms, create security risk, or expose FitAdEngine or others to liability.

Billing

Some FitAdEngine functionality may be free, in private beta, or offered through paid plans. If paid features are enabled, billing may be processed by Stripe or another payment provider. Fees, taxes, refunds, renewals, cancellations, and subscription changes will be presented in the applicable checkout, billing portal, or order flow.

Availability and Changes

We may modify, suspend, or discontinue parts of FitAdEngine at any time. We may update these Terms by posting a revised version. Continued use of the service after updates means you accept the revised Terms.

Account Suspension and Termination

You may stop using FitAdEngine at any time. We may suspend or terminate access if we believe you violated these Terms, created security risk, misused connected platforms, failed to pay applicable fees, or used the service in a way that may harm FitMacro, FitAdEngine, users, service providers, or third parties.

Disclaimers and Liability

FitAdEngine is provided as is and as available. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless FitMacro, FitAdEngine, and their owners, employees, contractors, and service providers from claims, damages, liabilities, costs, and expenses arising from your content, your connected accounts, your use of the service, your violation of these Terms, or your violation of law or third-party rights.

Governing Law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules, unless mandatory law in your location requires otherwise.
